a) These terms and conditions apply to all services rendered by 10x Growth Company GmbH (“Growth Academy”).
b) By booking any of our courses or engaging in a commercial engagement with us you accept these terms and conditions. You can find the terms and conditions on our website. If you would like to receive a copy of these, please send an email via contact form and we will send it to you.
c) We may update these terms and conditions from time to time. Please check our website for the latest version of the terms that apply.
2. Confidentiality, data protection, and intellectual property rights
a) Privacy is important to us. Any confidential and/or personal data (such as, but not limited to, email address, company data) is not shared with third parties and is not being used commercially by third parties (except if necessary to provide services related to and authorized by Growth Academy).
b) Please respect the confidentiality of any information shared in class, whether by the moderators, trainers, guest speakers, or any of the participants of the course. Growth Academy and its trainers do not share any confidential or sensitive information shared by the participants.
c) Our site and services contain copyrighted materials, trademarks, and proprietary information of Growth Academy and licensors of Growth Academy.
d) This includes, without limitation, video, text, photos, graphics, images, and audio (“Growth Academy Course Materials”).
e) By attending our Growth Academy or any other provided service you shall not obtain any right to the “Growth Academy Course Materials”. These materials may also not be shared in any way. If any course content would be shared, we may deny you further access to the course and/or the online learning platform. It is strictly forbidden to use any of our content (slides, reading list, exercises) for commercial growth training/services/workshops.
f) You are welcome to use all of our images and text in our blog / website, as long as you mention the source and include a “dofollow” link to the original. For the avoidance of doubt, you are not welcome to share any of the information provided to you in the “Growth Academy Course Materials” as long as they have not been publicly shared by Growth Academy.
Booking & registration
a) On our website you find an overview of the courses we teach. All the details of the course, including dates, location and price, are stated on the course page or in the email following application.
b) All prices mentioned on our website are inclusive of VAT (German USt), unless determined otherwise.
c) Payment of the course fee is due upon registration, unless it was agreed otherwise with Growth Academy.
Access to online learning platform
a) We provide all of our attendees' login credentials for our Online Learning Platform and Community (“OLP”). You are responsible for all the activities you make in your account.
b) Access to the OLP is strictly personal and you may not share your log-in details. If any suspicious activity is found in your account, we have the right to deny you further access and delete your account (without any liability).
c) You may share content within your organization, subject to our fair use policy. You may not use any content to offer commercial services that overlap with Growth Academy services, such as growth strategy course, workshops, or advisory, whether during courses or advisory sessions or thereafter.
d) We do not train companies who offer services that overlap with our services. We have the right to deny or remove you from the course and/or the OLP if you offer services that overlap with Growth Academy services.
Use of third-party services
We may give you access to external accounts but we are not responsible for the use of those services and their terms and conditions shall apply to the use of their services.
Cancellation, refund and no show policy
a) All subscription-based courses (e.g. Growth Strategy Deep Dive or Growth Strategy Fundamentals) can be canceled at any time before the renewal date. There shall be no refund of the course fees once a subscription is renewed.
b) If a client that booked a cohort-based program (e.g. a private course as part of a corporate or team program) or a dedicated advisory collaboration cancels the engagement after contract signature but no later than six weeks before the start date Growth Academy refunds 50% of the booking costs. If a client cancels within six weeks before the start date 25% of the booking costs are refunded. Outside the above deadlines clients are not eligible for refunds.
c) In the unlikely event Growth Academy cancels a cohort-based program or one of its workshops, or advisory sessions we will work with the cohort participants to find a new date that fits their schedule.
d) Growth Academy is not refunding canceled individual workshops, expert talks, or advisory sessions.
e) If a participant does not show up to a workshop session of a cohort-based program, advisory session, or expert talk. Growth Academy is not providing recordings of the workshop and there shall be no refund for the missed session.

Court and Jurisdiction
Applicable law and court
Place of jurisdiction: Berlin
German law is applicable.
Any dispute shall be submitted exclusively to the competent court in Berlin, Germany.
